Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NÜME mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

3. Health and Fitness Disclaimer

NÜME provides general fitness, exercise, and nutrition information and guidance, including content generated by automated tools. It is not medical advice and is not a substitute for professional medical care. Always consult a qualified healthcare professional before starting any exercise or nutrition program, especially if you have a medical condition, are pregnant, or take medication. You use the Service and act on its guidance at your own risk.

4. Subscriptions and Payments

Some features require a paid subscription. Subscriptions are billed through your Apple App Store or Google Play account. Payment is charged at confirmation of purchase, and subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You manage and cancel subscriptions through your Apple or Google account settings. Except where required by law, payments are non-refundable.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to access, tamper with, or disrupt the Service or other users’ accounts.
  • Upload content that is illegal, abusive, harassing, or infringes the rights of others.
  • Reverse engineer, copy, or resell any part of the Service except as permitted by law.

6. User Content

You retain ownership of the content you submit (such as logs, notes, and photos). You grant NÜME a limited license to store, process, and display that content solely to operate and provide the Service to you. You are responsible for the content you share with others through group features.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by NÜME and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or content except as necessary to use the Service.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, NÜME will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service.

11. Changes to the Service and Terms

We may modify or discontinue the Service, and update these Terms, at any time. We will post updated Terms here and revise the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which NÜME operates, without regard to conflict-of-law principles.
